The primary responsibility for promoting and protecting public health rests with the states. States regulate an enormous range of activities and behaviors in the name of public health. The broad authority of states to act in furtherance of health allows states to tailor public health law solutions to meet state and local needs. This authority also allows for policy experimentation, in which states try new solutions, or new variations, until the best legal practices can be identified through research.
